Ok, I'll have to post more on this later, but in short, it seems to me that we can't legally allow patrons to retain items they have damaged and paid for. According to Irving ordinances, we are to give all withdrawn items to the Friends (assuming we don't destroy them). I don't have time to post the proof right now, so I'll do it when I get back to a computer tomorrow. The problem basically is that a lot of SLAs want to let the patrons have the stuff because it truly is worthless and we won't give it to the Friends, we'll just throw it away. However, our civil ordinances (16-14c) says that we can't sell property to the public, our only options are to give it to the Friends or trash it. At least, that's what it seems to say. I raised the issue at the meeting and was met with confusion, resistance, and mild outrage that I would bring it up and say we might be doing something wrong, even though it's clearly written in our policies and in the City code.

What exactly do you mean? By city ordinance, we can give items to the Friends. As a charitable organization, the Friends can sell those items solely for the purpose of raising money for the library. I suppose that were the Friends not our designated recipients we could give items away to any charity, but we are expressly forbidden from selling our items. The argument I heard from a certain someone to rationalize this behavior basically boiled down to "We're not selling the patron our item, we're taking their money and then giving away something we weren't going to keep anyway." I guess she doesn't understand that we aren't allowed to give our items to anyone either.

The difference is that the City Council says you can do one and you can't do the other. Whether we agree with this or not, it has the strength of law and I'd rather not see library personnel flouting it. Perhaps the mechanics of the two are the same, but book sale money goes to the Friends and then to the Library, whereas damages and fees go to the City. The Library, as a department of the city, can not take money for property we own. Under no circumstances is this allowed, no matter the fact that we're basically doing the same on a larger scale with the Friends.

Well, I at least got Amanda to read the blog, but she didn't post anything, even though she had plenty to say pertaining to the subject of the de-professionalization of the IPL. When Kristina gets her computer set up at her home, I'll make her get on, read all the posts and make some comments.
